Welcome to TheNotaryNext. These Terms and Conditions ("Terms") govern your use of our platform at thenotarynext.com and app.thenotarynext.com (collectively, the "Services") operated by TheNotaryNext ("we," "our," or "us").
By creating an account or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
1. Eligibility
To use TheNotaryNext you must:
Be at least 18 years of age.
Be a commissioned Notary Public in good standing in the United States.
Have the legal authority to enter into a binding agreement.
Provide accurate and complete information during registration.
Maintain the security of your account credentials.
We reserve the right to refuse service, terminate accounts, or cancel subscriptions at our sole discretion if these eligibility requirements are not met.
2. Account Registration
a. Creating an Account
When you sign up, you agree to provide accurate, current, and complete information. You are responsible for keeping this information up to date through your account settings.
b. Account Security
You are solely responsible for:
Maintaining the confidentiality of your login credentials.
All activities that occur under your account.
Notifying us immediately of any unauthorized access or security breach.
We are not liable for any loss or damage arising from your failure to safeguard your account.
c. One Account Per User
Each user is entitled to one personal account. Sharing accounts between multiple notaries is not permitted. Team and multi-user accounts will be available in future versions.
3. Subscription and Billing
a. Free Trial
New users receive a 14-day free trial with full access to all features. No credit card is required to start the trial. At the end of the trial period, you must subscribe to a paid plan to continue using the Services.
b. Subscription Plans
Our current pricing is $15 per month for the Starter plan, billed monthly through Stripe. Pricing is subject to change with 30 days' notice to existing subscribers.
c. Payment Authorization
By subscribing, you authorize us to charge your payment method on a recurring monthly basis. You agree to keep your payment information current.
d. Failed Payments
If a payment fails, we will:
Attempt to charge your payment method up to 3 times over 7 days.
Notify you via email of failed attempts.
Suspend account access if payment cannot be completed within 14 days of the failed charge.
e. Refunds
All subscription fees are non-refundable. You may cancel at any time, but no partial refunds will be issued for unused portions of your billing cycle. You will retain access until the end of your current billing period.
f. Cancellation
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.
4. Acceptable Use
You agree NOT to use TheNotaryNext to:
Violate any local, state, or federal laws.
Impersonate another person or misrepresent your identity.
Send unsolicited spam, promotional content, or unauthorized commercial messages.
Upload malicious code, viruses, or harmful content.
Attempt to gain unauthorized access to our systems or other users' accounts.
Scrape, copy, or extract data from the Services using automated tools.
Interfere with or disrupt the operation of the Services.
Use the Services to harass, threaten, or harm any individual.
Process or store payment information outside of our integrated payment processors.
Resell, sublicense, or commercially exploit the Services without written permission.
Violation of these terms may result in immediate account termination without refund.
5. Your Content and Data
a. Ownership
You retain full ownership of all content and data you upload to TheNotaryNext, including:
Signer information and contact details.
Job records and signing notes.
Invoice data and payment records.
Uploaded documents and files.
b. License to Operate
By uploading content, you grant us a limited, non-exclusive license to store, process, and display that content solely for the purpose of providing the Services to you.
c. Your Responsibility
You are solely responsible for:
Ensuring you have the right to upload any content.
Obtaining proper consent from signers, title companies, and other parties before storing their information.
Complying with all applicable privacy laws when collecting and processing customer data.
The accuracy of invoices, fees, and payment terms you create.
We do not verify the accuracy of user-generated content.
6. Automated Communications
TheNotaryNext enables you to send automated emails and SMS messages to your signers and title companies. By using these features you agree:
You are solely responsible for the content of all communications sent through the platform.
You have obtained proper consent from recipients to receive automated communications.
You will comply with all applicable laws including CAN-SPAM, TCPA, and state-level communication laws.
You will not use automated messaging for spam, harassment, or unauthorized marketing.
Recipients must have the ability to opt out of communications.
TheNotaryNext is not responsible for compliance failures arising from your use of automated communications.
7. Notary Services Disclaimer
TheNotaryNext is a software platform. We are not a notary service provider.
We do not perform notarizations.
We do not certify, verify, or guarantee the accuracy of any notarial acts performed through the use of our Services.
You are solely responsible for performing notarizations in compliance with the laws of your commissioning state.
We are not liable for any errors, omissions, or legal consequences arising from your notarial services.
You must maintain your own notary commission, bond, and errors and omissions (E&O) insurance as required by your state.
8. Third-Party Services
TheNotaryNext integrates with third-party services including:
Stripe — for payment processing
Postmark — for email delivery
Twilio — for SMS messaging
Google — for Maps, Calendar, and Reviews integration
These third parties operate under their own terms of service and privacy policies. We are not responsible for the actions, content, or policies of these providers.
9. Intellectual Property
a. Our Property
The Services, including all software, design, text, graphics, logos, and trademarks are owned by TheNotaryNext and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
b. Feedback
If you provide feedback, suggestions, or ideas about the Services, you grant us a royalty-free, perpetual, irrevocable license to use that feedback to improve our platform without compensation or attribution.
10. Service Availability
We strive to maintain 99% uptime but do not guarantee uninterrupted access to the Services. We may:
Perform scheduled maintenance with reasonable advance notice.
Modify, suspend, or discontinue features at our discretion.
Limit access during periods of unusually high demand.
We are not liable for any losses arising from temporary unavailability or service interruptions.
11. Limitation of Liability
To the maximum extent permitted by law:
TheNotaryNext is provided "as is" and "as available" without warranties of any kind, express or implied.
We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.
Our total liability for any claim arising from your use of the Services shall not exceed the amount you paid us in the 12 months preceding the claim.
We are not liable for indirect, incidental, special, consequential, or punitive damages including lost profits, lost revenue, or lost data.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of these provisions may not apply to you.
12. Indemnification
You agree to indemnify, defend, and hold harmless TheNotaryNext, its officers, directors, employees, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:
Your use of the Services.
Your violation of these Terms.
Your violation of any third-party rights including privacy or intellectual property rights.
Your notarial acts or services performed using the platform.
Any content you upload or transmit through the Services.
13. Termination
a. By You
You may terminate your account at any time by canceling your subscription through your account settings.
b. By Us
We may suspend or terminate your account immediately, without notice, if you:
Violate these Terms.
Engage in fraudulent or illegal activity.
Fail to pay subscription fees.
Use the Services in a manner that harms our platform or other users.
c. Effect of Termination
Upon termination:
Your access to the Services will be discontinued.
Your account will enter a 30-day read-only period during which you can export your data.
After 30 days, your account and all associated data will be permanently deleted.
Sections 5, 9, 11, 12, 14, and 15 will survive termination.
14. Modifications to These Terms
We may update these Terms periodically. When we make material changes, we will:
Update the "Last Updated" date at the top of this page.
Notify you via email or in-app notification at least 30 days before changes take effect.
Provide you the option to cancel your subscription if you disagree with the changes.
Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.
15. Governing Law and Dispute Resolution

a. Informal Resolution
Before filing any legal action, you agree to first attempt to resolve disputes informally by contacting us at contact@thenotarynext.com. We will respond within 30 days.
b. Arbitration
Any unresolved disputes shall be resolved through binding arbitration in [Your County, Your State] under the rules of the American Arbitration Association. You waive any right to a jury trial.
c. Class Action Waiver
You agree to resolve disputes on an individual basis. You waive any right to participate in class action lawsuits or class-wide arbitration.
16. Miscellaneous

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TheNotaryNext regarding the Services.
b. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
c. No Waiver
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
d. Assignment
You may not assign these Terms without our written consent. We may assign these Terms at any time without notice.
e. Force Majeure
We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control including natural disasters, war, terrorism, pandemics, or government actions.
